1. Agreement to Terms
By downloading, installing, or using StreakWalk ("App," "we," "us," "our," or "Company"), you agree to these Terms of Service ("Terms"). If you don't agree, do not use the App.
We may modify these Terms at any time. Continued use constitutes acceptance. We'll notify you of material changes via email or in-app notice.
2. Eligibility and Account Registration
2.1 Age Requirements
You must be:
- At least 13 years old to create an account
- 18+ in California, GDPR-regulated regions, and certain other jurisdictions
- Capable of entering into a legal agreement
We do not knowingly allow users under 13 to create accounts. Violation may result in immediate termination.
2.2 Accurate Information
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Update information if it changes
- Not impersonate another person or entity
- Not create multiple accounts to cheat or manipulate challenges
- Not use fake information or misleading identities
2.3 Account Security
You are responsible for:
- Keeping your password confidential
- Not sharing your account with others
- Notifying us immediately of unauthorized access or suspicious activity
- All activity that occurs under your account
- Compliance with these Terms
We are NOT responsible for unauthorized access resulting from your failure to protect your password.
2.4 Account Changes and Deletion
You can:
- Update profile information anytime in Settings
- Delete your account via Settings → Account → Delete Account
- Request email confirmation before deletion
Account deletion is permanent and irreversible. All associated data will be deleted within 90 days.
3. Critical Health and Fitness Disclaimers
3.1 NOT a Medical Device
StreakWalk is a fitness tracking application, NOT a medical device.
The App does NOT:
- Diagnose, treat, cure, or prevent any medical condition
- Provide medical advice or healthcare services
- Replace professional medical evaluation or treatment
- Monitor vital signs or medical metrics
- Provide health recommendations
3.2 Fitness Tracking Limitations
Step Count Accuracy:
- Accuracy depends on your device's motion sensors
- Environmental factors affect accuracy (terrain, walking speed, arm movement)
- We do not guarantee 100% precise step counting
- Different devices may show different step counts
- Sensor calibration affects results
Other Limitations:
- We do not track calories burned
- We do not measure heart rate or other biometrics
- We do not provide fitness recommendations
- We do not monitor physical condition changes
3.3 Before You Start
You must consult with a qualified healthcare provider before using StreakWalk if you have:
- Cardiovascular conditions (heart disease, high blood pressure, arrhythmia)
- Joint or mobility issues (arthritis, knee/ankle problems)
- Respiratory conditions (asthma, COPD)
- Neurological conditions
- Pregnancy or postpartum concerns
- Chronic pain or injury
- Diabetes or metabolic disorders
- Any other medical condition
- Currently taking medications affecting exercise
- Haven't exercised regularly in the past year
3.4 Stop Immediately If You Experience
- Chest pain or pressure
- Shortness of breath or difficulty breathing
- Dizziness, lightheadedness, or fainting
- Severe joint or muscle pain
- Nausea or other concerning symptoms
- Any adverse physical reaction
Stop activity immediately and seek emergency medical care if needed.
3.5 Assumption of Risk
By using StreakWalk, you acknowledge and assume:
- All risks associated with walking and physical activity
- That physical activity carries inherent health risks
- That you have consulted with a healthcare provider
- That you are physically capable of the activity
- That you release StreakWalk from liability for injuries or health issues
We are not responsible for any injury, illness, or adverse effects from using StreakWalk or walking.
4. Using StreakWalk Responsibly
4.1 Prohibited Activities
You agree NOT to:
Data Manipulation:
- Artificially inflate step counts
- Use bots, scripts, or automated tools to generate false data
- Export or tamper with step data
- Create fraudulent activity records
- Manipulate daily goals or targets
Account Abuse:
- Create multiple accounts to gain unfair advantage
- Share your account with others
- Sell, trade, or transfer your account
- Impersonate other users
- Create fake profiles for challenges
Community Violations:
- Harass, threaten, or bully other users
- Post discriminatory, hateful, or offensive content
- Spam or advertise commercial products
- Share another user's personal information
- Engage in hate speech or abusive behavior
Technical Abuse:
- Reverse engineer or decompile the App
- Access unauthorized backend systems
- Scrape or extract data without permission
- Interfere with server operation
- Attack or compromise security
Fraud:
- Cheat in challenges through data manipulation
- Win challenges using false data
- Use exploits to gain unfair advantages
- Claim false achievements or badges
4.2 Enforcement
Violations may result in:
- Warning via email
- Suspension of account (temporary)
- Permanent termination of account
- Forfeit of premium subscription (non-refundable)
- Removal from challenges and leaderboards
- Report to law enforcement (if illegal)
5. StreakWalk Features and Mechanics
5.1 Daily Streaks
How Streaks Work:
- A streak increases by 1 for each day you meet your daily goal
- Missing your goal breaks your streak (resets to 0)
- Your streak is tracked in your profile and visible to you
- In challenges, streaks are reset daily
Streak Reset Conditions:
- Goal not met by end of day (11:59 PM in your timezone)
- Shield not used OR shield already used
- Grace day not available (First Week only)
Longest Streak:
- Permanent record of your highest consecutive days
- Never resets, only increases
- Shown on your profile
5.2 Shields (Streak Protection)
Free Users:
- 1 shield per week (resets every Monday at 12:00 AM UTC)
- When used, protects your streak if you miss a goal the next day
- Cannot stack shields or carry over unused shields
Premium Subscribers:
- Unlimited shields
- Use shields anytime without weekly limits
- Each shield protects one missed day
Shield Mechanics:
- Shield is used automatically if you don't meet your goal and have one available
- Once shield is used, the day counts as "completed" for streak purposes
- Shield status is shown in your daily dashboard
- Cannot be refunded or transferred
5.3 First Week Experience
7-Day Mission Series:
- Personalized onboarding for new users (Days 1-7)
- Each day has specific missions and learnings
- Missions teach app features, health benefits, and habit building
Grace Day:
- One-time protection available during First Week only
- Automatically used if you miss a goal AND have no shield
- Allows you to miss one day without breaking your streak
- Only works during Days 1-7 of your journey
- Cannot be used after First Week ends
First Week Completion:
- Completing all 7 days unlocks first achievement
- Unlocks first avatar
- Graduates you to the main app experience
5.4 Daily Goals
Goal Range:
- Minimum: 3,000 steps per day
- Maximum: 15,000 steps per day
- Default: 6,000 steps per day
Changing Goals:
- Change anytime via Settings
- New goal applies to next calendar day
- Historical data not affected
- Goal changes are tracked
Goal Completion:
- Determined by Apple Health (iOS) or Google Health Connect (Android)
- Calculated at end of each day (11:59 PM in your timezone)
- Cannot be manually overridden
- Retroactive adjustments not possible
6. Challenges
6.1 Challenge Types
Friend Challenges (Private):
- Invite specific users via unique join code
- Only invited participants can see each other's steps and leaderboard
- Duration: 24 hours, 3 days, or 7 days
- Winner: User with most total steps at end
- Steps visible only to participants
Public Challenges (Open):
- Anyone on StreakWalk can view and join
- Display name and steps visible on public leaderboard
- Non-participants can view but cannot join
- Duration: 24 hours, 3 days, or 7 days
- Permanent leaderboard record after completion
- Results archived in your challenge history
6.2 Challenge Participation
Joining Challenges:
- Accept challenge rules when joining
- Step count begins counting immediately upon join
- Cannot leave challenge once joined
- Must complete duration to appear on final leaderboard
Step Counting:
- Only steps synced during challenge duration count
- Steps from before join time do NOT count
- Steps after challenge ends do NOT count
- Data source: Apple Health or Google Health Connect
Challenge Results:
- Determined automatically by total steps during challenge
- No manual intervention possible
- Results final and non-appealable
- Winners announced when challenge ends
6.3 Challenge Rules and Fair Play
By creating or joining a challenge, you agree to:
- No Data Manipulation: Not artificially inflating steps
- No Cheating: Not using exploits or fraudulent methods
- Fair Competition: Competing honestly with other users
- No Harassment: Respecting all participants
- Honest Information: Not providing false step data
Violations Result In:
- Disqualification from current and future challenges
- Removal from leaderboards
- Account suspension (temporary or permanent)
- Forfeiture of challenge rewards
7. Premium Subscription
7.1 Premium Features
Premium subscribers receive:
- Unlimited Shields: Protect streaks unlimited times per week (vs. 1 free per week)
- [Add other premium features from your specific offering]
- Access to premium-exclusive challenges or features (if applicable)
7.2 Billing and Pricing
Payment Processing:
- Handled by RevenueCat, Apple App Store, or Google Play Store
- NOT charged directly by StreakWalk
- We do NOT store credit card information
- Charges appear under app store name on your statement
Pricing:
- Displayed in your device's currency
- Subject to applicable taxes
- May vary by region and currency
Billing Cycle:
- Monthly, 6-month, or annual options (if offered)
- Charges applied at start of each billing period
- Your app store account controls billing
7.3 Subscriptions and Auto-Renewal
Auto-Renewal:
- Premium subscriptions automatically renew at end of billing period
- Renewal charge applied unless you cancel beforehand
- Confirmation shown before first charge
Cancellation:
- Cancel anytime through your app store account:
- iOS: Settings → [Your Name] → Subscriptions → StreakWalk → Cancel
- Android: Google Play → Account → Subscriptions → StreakWalk → Cancel
- Cancellation takes effect at end of current billing period
- No refunds for partial periods
- Premium access continues until billing period ends
7.4 Free Trials (if applicable)
- Free trial period length specified at purchase
- Non-refundable if charged after trial
- Auto-renewal to paid subscription after trial unless canceled
- You must cancel before trial ends to avoid charge
- Once charged, subscription follows standard refund policy
7.5 Refund Policy
Non-Refundable:
- Subscriptions are generally non-refundable after purchase
- Partial month/period refunds not available
- Cancellation takes effect at end of current period
Exceptions:
- Apple/Google may grant refunds per their policies (contact them directly)
- Technical issues preventing service may qualify for review
- Refund requests must be submitted within 30 days of charge
7.6 Price Changes
- Prices may change with 30 days' notice
- Existing subscriptions keep current price until next renewal
- New prices apply at renewal unless you cancel
- We'll notify you of significant price increases
7.7 No Refund Upon Termination
If your account is terminated for violating these Terms:
- Premium subscription is non-refundable
- No partial refunds for remaining subscription period
- Termination takes effect immediately
8. User Content
8.1 Your Content
"User Content" includes:
- Display name and profile information
- Challenge comments or messages
- Feedback and support communications
- Avatar and badge selections
- Any other content you create
8.2 Your Rights to Your Content
You retain ownership of content you create. By submitting content to StreakWalk, you grant us:
- Right to use, store, and display your content
- Right to use anonymized content for analytics
- Right to display your step data in challenges/leaderboards
- Right to share aggregate statistics
- Right to back up and replicate content
8.3 Content Standards
You agree not to post:
- Profanity, obscene, or sexually explicit content
- Hate speech or discriminatory content
- Threats, harassment, or abuse toward others
- Spam, advertising, or commercial promotion
- Copyright-infringing material
- False, misleading, or fraudulent information
- Personal information of others without consent
- Malware or harmful code
8.4 Content Removal
We may remove any content violating these Terms:
- Without prior notice
- At our sole discretion
- Without refund or compensation
Repeated violations result in account suspension or termination.
9. Intellectual Property Rights
9.1 StreakWalk Ownership
All content in StreakWalk is owned by StreakWalk or licensed partners:
- Software: App code, features, algorithms, functionality
- Design: UI/UX, graphics, visual assets, animations
- Content: Text, images, badges, avatars, icons
- Trademarks: "StreakWalk" name, logo, branding
- Data: Leaderboards, challenge archives, aggregated statistics
Protected by copyright, trademark, patent, and trade secret laws.
9.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Download and install the App
- Use the App for personal, non-commercial purposes
- View your own data and achievements
You may NOT:
- Copy, reproduce, or modify the App or its content
- Create derivative works or adaptations
- Decompile, reverse engineer, or disassemble code
- Extract or export data without authorization
- Use StreakWalk branding or IP for commercial purposes
- Distribute, sell, or rent the App
- Claim ownership of any StreakWalk intellectual property
10. Limitation of Liability
10.1 Disclaimer of Warranties
StreakWalk is provided "AS IS" without any warranties.
We do NOT warrant:
- The App will be error-free, uninterrupted, or secure
- The App will meet your needs or expectations
- Step counts will be 100% accurate
- Data will never be lost or compromised
- The App will be compatible with all devices
- Data breaches will never occur
10.2 Disclaimer of Health Warranties
Especially important: We do NOT warrant:
- That walking is safe for your specific health condition
- That you won't experience injury or illness
- That step counts reflect actual health benefits
- That the App is suitable for any medical condition
- That using the App will improve your health
Consult a healthcare provider, not the App, for health decisions.
10.3 Limitation of Damages
To the fullest extent allowed by law, we are NOT liable for:
- Indirect damages: Lost profits, lost earnings, lost data, lost savings
- Incidental damages: Costs of replacement, recovery, substitute services
- Consequential damages: Damages flowing from your use
- Health-Related: Any injury, illness, or adverse health effects
- Data-Related: Inaccurate step counts, lost data, data breaches
- Third-Party: Actions, content, or services of third parties
- Business Losses: Lost revenue, business interruption
10.4 Maximum Liability
Our total liability to you shall not exceed:
- The amount you paid for premium in the past 12 months, OR
- $0 USD if you use the free version
This applies to all claims, damages, and causes of action.
10.5 Essential Terms
You acknowledge that:
- These limitations are essential to our ability to provide the App
- You would not use the App without these limitations
- These limitations apply even if any remedy fails its essential purpose
11. Indemnification
You agree to defend, indemnify, and hold harmless StreakWalk, its officers, directors, employees, and agents from:
- Claims arising from your use of the App
- Your violation of these Terms
- Your violation of applicable law
- Your infringement of third-party rights
- Your content or conduct in the App
- Your violation of other users' rights
- Any claims that your conduct caused damages
This applies regardless of the claim's merit, and includes attorney fees and costs.
12. Third-Party Services
12.1 Health Platform Integrations
StreakWalk reads step data from:
Apple Health (iOS):
- You control access in Health app settings
- Apple's Privacy Policy governs Health data
- We read only what you authorize
- We're not responsible for Apple Health policies or practices
Google Health Connect (Android):
- You control access in Health Connect settings
- Google's Privacy Policy governs Health Connect data
- We read only what you authorize
- We're not responsible for Google Health Connect policies
Revoking Access:
- iOS: Settings → Health → Data Access & Devices → StreakWalk → Toggle Off
- Android: Health Connect → Permissions → StreakWalk → Revoke
12.2 Payment Processors
- RevenueCat: Subscription management
- Apple App Store: iOS payments
- Google Play Store: Android payments
These are governed by their respective terms and we're not responsible for their practices.
12.3 No Responsibility for Third Parties
We are NOT responsible for:
- Third-party services, policies, or practices
- Data handling by third parties
- Breaches or issues with third-party systems
- Any damages from third-party services
13. Termination and Account Suspension
13.1 Termination by You
You can delete your account anytime:
- Via Settings → Account → Delete Account
- Email support@streakwalk.app with deletion request
- Deletion is permanent and irreversible
- Your data is deleted within 90 days
13.2 Termination by StreakWalk
We may suspend or terminate your account immediately if you:
- Violate these Terms of Service
- Engage in illegal or fraudulent activity
- Manipulate challenges or step data
- Harass or abuse other users
- Repeatedly violate community standards
- Fail age verification requirements
- Pose security or legal risks
Termination is effective immediately without refund.
13.3 Upon Termination
- Your account access is revoked
- Your data may be retained for 90 days
- Your profile is removed from public leaderboards
- Challenge history may remain archived
- Premium subscription is non-refundable
- You cannot appeal termination (except valid legal requests)
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.
You consent to the exclusive jurisdiction and venue of courts located in [Your Location] for any legal action or proceeding.
15. Dispute Resolution
15.1 Informal Resolution (First Step)
Before pursuing legal action:

- Describe the dispute clearly
- Provide relevant details and documentation
- Allow 30 days for good faith resolution
Most disputes can be resolved this way.
15.2 Binding Arbitration
If informal resolution fails, you and StreakWalk agree to resolve disputes through binding arbitration rather than court, except:
- Either party may pursue injunctive relief for IP infringement
- Small claims court claims are permitted (under $5,000)
Arbitration Terms:
- Neutral, independent arbitrator
- Conducted remotely or in [Your Location]
- You pay your costs; we pay ours
- Limited discovery
- Arbitrator's decision is final and binding
- Enforceable in any court
15.3 Class Action Waiver
You agree NOT to participate in any class action, class arbitration, or representative action against StreakWalk.
All disputes must be resolved individually, not on behalf of a class of users.
16. Changes to the App
We reserve the right to:
- Modify, update, or improve features
- Discontinue features or functionality
- Change how the App works
- Remove content or capabilities
- Restrict access to features
We'll provide notice when possible, but changes can be made without notice.
17. DMCA Copyright Infringement
17.1 Copyright Notice
If you believe StreakWalk infringes your copyright, submit a notice including:
- Your name and contact information
- Description of the copyrighted work
- Location of infringing material in StreakWalk
- Your statement of good faith belief of infringement
- Your statement (under penalty of perjury) of accuracy
- Your physical or electronic signature

17.2 Counter-Notice
If your content was removed, you may submit a counter-notice with:
- Your name, address, and contact information
- Description of removed content
- Statement under penalty of perjury that removal was in error
- Consent to jurisdiction of courts

We'll reinstate content if a valid counter-notice is received.
18. Severability
If any provision is found invalid or unenforceable by a court:
- That provision is severed
- Remaining provisions continue in full force
- If severing impacts enforceability, we'll modify minimally to preserve intent
19. Entire Agreement
These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and StreakWalk regarding the App. They supersede all prior agreements, understandings, negotiations, and discussions.

- You are responsible for consulting healthcare providers regarding physical activity
